Welcome to Folliva. These Terms of Service ("Terms") govern your access to and use of thefolliva.com (the "Site"), as well as any purchases, subscriptions, products, content and services offered by Folliva ("Folliva," "we," "us" or "our").

By accessing our Site or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

Folliva operates thefolliva.com and provides cosmetic hair-care products and accessories, including The Growth System by Folliva, the Advanced Growth Complex, the Density Support Shampoo + Conditioner, and related products.

2. Eligibility

To use the Site and purchase products, you must:

Hair growth, reduction in shedding, scalp appearance improvements and other cosmetic outcomes depend on numerous factors, including age, genetics, hormones, health status, consistency of use and individual biology.

4.3 Pricing

Unless otherwise stated:

  • All prices are listed in U.S. Dollars (USD)
  • Shipping and taxes may be charged separately
  • Prices may change at any time
  • Price changes do not affect completed orders

If a pricing error occurs, we reserve the right to cancel or correct the affected order.

8. Intended use of products

8.1 Cosmetic use only

Folliva products are intended solely for cosmetic purposes.

Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease, disorder or medical condition. Nothing on the Site constitutes medical advice.

8.2 Consult a healthcare professional

You should consult a qualified healthcare provider before using Folliva products if you:

  • Are pregnant or breastfeeding
  • Have a scalp condition
  • Have a medical condition
  • Take prescription medications
  • Have concerns about the causes of your hair loss

8.3 User responsibilities

You agree to:

  • Follow all instructions provided
  • Use products only as directed
  • Discontinue use if adverse reactions occur
  • Seek professional medical advice when appropriate

Our products include a device that punctures the surface of the skin. Used as directed it is well tolerated, but temporary redness, tenderness or mild irritation can occur. Do not share the device, do not use it on broken, infected or inflamed skin, and follow the cleaning instructions in the manual.

8.4 Prohibited uses

You agree not to:

  • Misuse products
  • Modify or reverse engineer any device
  • Use products unlawfully
  • Resell products without authorization
  • Make false claims regarding Folliva products

9. Subscription programs

Where Folliva offers subscription services:

  • Subscription pricing and frequency are disclosed before purchase
  • Your subscription automatically renews until canceled
  • You may manage or cancel through your account, the link in your order emails, or by contacting support
  • Cancellation applies to future shipments only
  • Previous charges are non-refundable unless required by law or covered by our Refund & Return Policy

10. Warranty

10.1 Limited warranty

Folliva devices include a 1-year limited manufacturer warranty as described in our Refund & Return Policy.

10.2 Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCEPT FOR ANY EXPRESS WARRANTY PROVIDED BY FOLLIVA, ALL PRODUCTS, SERVICES, CONTENT AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

FOLLIVA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • WARRANTIES ARISING FROM COURSE OF DEALING

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, limitations apply only to the extent permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLLIVA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, SUPPLIERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO your use of the Site or our products.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to any order will not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, these limitations apply only to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Folliva and its officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or connected with your breach of these Terms, your misuse of our products, or your violation of any law or the rights of a third party.

13. Intellectual property

All content on the Site, including text, graphics, logos, images, product designs, page layouts and trademarks, is owned by or licensed to Folliva and is protected by intellectual property laws. See our Legal Notice.

You may not copy, reproduce, distribute, modify, republish or otherwise exploit any part of the Site without our prior written permission.

If you submit a review, photograph, comment or other content to us, you grant Folliva a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with our products and marketing, and you confirm that you own it and that it is accurate.

14. Third-party links and services

The Site may link to or rely on third-party services, including payment processors, review platforms, subscription tools and analytics providers. We are not responsible for the content, policies or practices of third parties, and your use of their services is governed by their own terms.

15. Termination

We may suspend or terminate your access to the Site, or refuse to serve you, at any time, with or without notice, if we reasonably believe you have breached these Terms or used the Site unlawfully. Sections that by their nature should survive termination, including sections 10 to 16, will survive.

16. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules.

If you are a consumer, nothing in this section deprives you of the protection of the mandatory consumer-protection laws of the country or state in which you live, and you may bring a claim in the courts of that place where the law gives you that right.

17. Changes to these Terms

We may update these Terms from time to time. The version posted on thefolliva.com at the time of your purchase is the one that applies to your order. Material changes take effect when posted, and the "last updated" date above will change. Continuing to use the Site after that means you accept the updated Terms.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies linked from them, make up the entire agreement between you and Folliva regarding the Site and your purchases.
